NYS Division of Licensing Procedural List Updates

Stylists all over New York are freaking out over the Division of Licensing procedural notice that was sent out to everyone with a NYS license in the Appearance Enhancement (beauty) Industry yesterday, and for good reason.

This email is basically notification of updates to the procedural services list that breaks down what your license does and does not cover.

Below is a screenshot of the letter anyone with an appearance enhancement license received in their email registered with NYS DOL yesterday.


UPDATE: As of 4th September 2024, Licensed Cosmetologists in the State of New York may now resume brow and lash tinting services.

I did a podcast on this list in March of last year on this topic, and in this blog post I will be going over the differences in what has changed since that podcast released March 17, 2022. If you’d like to listen to this podcast you can do so HERE.

Not much has changed, so the drama can to stop. If you can’t even research what services you are allowed to perform, you definitely can’t handle the research involved with performing said procedures.

Some of these procedures require intense training, research, reading, and hours of apprenticing before you fully understand them. Taking shortcuts isn’t fair to the Professionals who follow these guidelines properly and obtain the proper licensing to do so.

Not only that, but if you don’t have the proper licensing, YOU DON’T HAVE PROPER INSURANCE. Which means if you hurt someone when doing a service illegally, you could lose your license, your business, and you could be sued for everything you worked so hard to build, like your house!


Below are screenshots of the updates in this official 8 page list of procedures. Not much has changed, so I will note what hasn’t changed, and highlight what has. I’ve also organized it with the header column on each page so you will be able to read it easier, without having to reference the title page each time. The header shows you what services fall under which license. For example; When it states “Medical”, that means you either have to be a licenses Doctor OR work under one with proper licensing. Having a nursing license does not qualify you to perform medical services in a day spa, but if you are a nurse working in a MEDSPA, under the direction of a physician, you can.

Lash Lifts now are MOSTLY keratin Lash Lifts as opposed to Eyelash Perms, so just be careful ordering your products to make sure you are ordering Keratin Lash Lifts.

This change is good news! This is a service that’s been ADDED to our Cos and Aesthetic licenses! They have properly divided the types of lasers and LED light therapy for us!

Also, side note;

Makeup is and has ALWAYS been under the Aesthetics and Cosmetology license. It has NEVER been under waxing, or nails. I have heard of some nail and wax schools telling students this so that they get their business, but it has NEVER been the case. EVER.

This also includes Stylists who only do Bridal. There are sooooo many of you out there without a Cos or Aesthetics license making money under the table, without proper licensing or insurance and it’s taking business away from the ones who are. It’s so unfair to the stylists who spent thousands of dollars on education, child care and more, and is entirely unethical.

The Plasma pen and hyaluron pen were what prompted me to do the podcast last year, because for a hot minute, the Hyaluron Pen was allowed under a Cos license but was reviewed and placed under medical, and the Plasma Pen was always medical but hit the beauty industry like wildfire even though it fell under medical. There are a lot of salons and spas out there performing this illegally, buyer beware.

Let’s be real for a minute. I’m not here to make friends. I am here to work my ass off and make money. I don’t make many friends in this industry because I will call them out on their bullshit, like I am about to now.

The reason Stylists are freaking out are because they are realizing now that services they have been performing and making easy stupid money on, are in fact ILLEGAL, OR they have been doing them all along illegally and are now scared that they will be held accountable.

These same stylists are probably also the same ones who worked illegally during the pandemic making house calls when we were all supposed to shut down and wait it out. All while making money under the table AND claiming unemployment benefits.

If you’re not doing anything wrong, you’ve got nothing to worry about!
